As universally known, the U.S. Supreme Court (“SCOTUS”) is the highest in the federal judiciary. It has ultimate appellate jurisdiction over all Federal cases, as well as State Court cases which involve constitutional issues or Federal law.

Until recently, the venerable High Court was, creditably seen as an avatar of justice, interpreter of the Law and the Constitution, and the ultimate source of American Justice. With few exceptions, its judicial rulings shored up the legal context of the Nation, as intentionally authored by the Founders, and were a consistent guardian of the rights of its citizens. The Court’s high revered Justices included John Marshall, Oliver Wendal Holmes, William Brennan, Benjamin Cardozo, Earl Warren, Louis Brandeis, Felix Frankfurter, Ruth Bader Ginsburg, and William Douglas. Where there anecdotally existed an ambiguity or inconsistency in the law, as between States, in the lower courts, or esoteric issues concerning appellants and institutions, such legal dilemmas were resolved and morphed into National legal precedent.

The wise, precedential decisions of SCOTUS were espoecially revered by us as idealistic law students, and, in our subsequent fifty-year- long, professional practice, they served, when relevant, as an ultimate guide. Many of the justices, in addition to their juridical acumen, were gifted enough to express their legal opinions in admirably aesthetic language, adding to the recognition of the Court’s erudition and our profound respect. The fictional status of corporations as “persons” is a universally recognized “legal fiction” for the protection of a proprietor of (an incorporated) business from personal financial liability ande thereby encourage new business enterprise. No humanistic”personhood” was ever intended by this universal law. In fact the legal fiction of corporate “person” was first legislated in the Statutes of Elizabetrh, in an era when a debtor in England was subject to incarceration.

It has been frustratingly painful to observe the moral and professiional decline of impartial objectivity by the Court’s unprincipled four Justice, right-wing majority of the extant Supreme Court. It is our v iew that their venerable predecessors would be incredulously astonoshedv at the unprecedented decline of judicial morality and fiduciary responsiblity of the Court, exemplified by the four conservative Justices; Justice Samuel Alito has [publicaly shown himself to be partial to the religious lobby and a devotee of the White e Christian Malitias (viz,. flying militia style flag, unfaillingly rendering decisions in accordance with the interest of the Nation’s religious lobby. and Justice Clarence Thomas admission of being the tecipient of lavish gifts and vacations from rich conservative donors. The revealed level of the determinative right-wing majority is disappointingly incompatible with the vaunted history of SCOTUS up to twenty five years ago

The Founders’ (optimistic) expectation was that the issues of the day would be dutifully debated by informed citizens, and that the result of such debates would inform the government, designated to be “by and for” the “People.” In empirical reality, differences in opinion led to rancor and divisiveness. Individuals would form groups of like opinion (“groupthink”), which were in a “Cold War” with other groups maintaining disparate views. The notably contested and divisive issues, more recently, have related to the Vietnam War, gun control, abortion rights, and immigration. In contrast to the Pollyannaish predictions of the venerable Founders of the salutary practice of responsible citizen debate, controversial issues led to hostility and social divisiveness. Such malign actions were undertaken to the delight of the ignorant, grievance-ridden, reductive populists who helped him get elected.

Mainstream American citizens were systemically shocked and revolted at the dystopic, un-American policies of Donald Trump and entertained feelings of profound dismay and disbelief that so many American citizens appeared to support such a President whose empirical incapability was equal in degree to his demonstrated lack of moral compass and serial mendacity..

The singular objecting party in America’s traditional “two-party system” was limited to one party, the Democrats.

Donald Trump’s hubristic acts of neo-authoritarianism soon metastasized to the toxic degree of assembling a Gestapo-like private militia of masked and military-style dressed goons. charged with the nefarious duty of arresting, incarcerating, and banishing to foreign torture prisons, peaceful. productive, tax-paying, and military-serving Hispanic Americans, absent due process, founded upon the evidence consisting of their tan colored skin and use of Spanish. The silent acquiescence of the Republican Congress was deafening and inarguably articulated its demise, and the effective end of the Nation’s traditional two-party rule.

Trump, unfettered by law or reason, went on to enact, by his magic felt-tip pen, all manner of governmental policies. legal and illegal, unauthorized by Law and the Constitution, declaring war against Venezuela, Iran, and ubiquitously performing official acts constitutionally designated to Congress, including the misguided imposition of high tariffs on foreign trade, inclusive of our intimate trading partners, notably, without comment from the members of the theoretical existence of the Republican Congress or deterrance from the no longer, impartial, SCOTUS.

In our experience, all extreme actions, however temporarily successful, have an empirical limit, whether physical or doctrinal. Donald J Trump, swollen with delusional pride at his earlier autocratic successes, went completely beyond the pale in hubristically and illegally (“Posse Comitatus”) calling up the military (National Guard) to police selected (Democratic leaning, significantly, black citizen-populated) cities. Huge “NO KING” demonstrations of millions of Americans (Republicans and Democrats, as a temporal “duality,” are set to take place today, in National protest to the obscene and hubristicd autocratic presumption of the orange, “would-be dictator’ who in his “Caesar-like” dreams of unlimited power, has recently presumed to majestically use the nation’s military as his personal “Palace Army.” The coming elections will not feature the traditional contest between the Democratic Party program versus that of the Republican, but uniquely, American democracy versus atavistic tyranny.

The anticipated expression of American citizen concord, articulated by the “NO KING’S” demonstration, is emotionally and factually resonant with our profound memory of united, joyful Americans celebrating the victory over the Axis Powers, following the Second World War.

Our issue du jour, relates to the ultimate size and the extent of impact on society of the offensively “spoiled barrel.”

In our view, the temporal damage to individual rights and liberties, as assured by the American Constitution, as well as the absence of respect for the rule of law, is empirically temporal and can be salubriously restored by suitable policies and the dedicated renewal of normative polity. We are fearful, however, that the abnegation by the Trump-MAGA administration of certain societally existential mandates may, conceivably, portend chronic and fundamentally retrogressive sequelae.

Our perturbation relates to the potential extent of the toxic Trump-MAGA injury to the compliance with the fundamental “social compact,” underlying the basic dynamics requisite to Man’s living in society with others. The damage inflicted to the anthropological concept of ‘The Social Contract,” described by Rousseau and others, i.e., the voluntary surrender of certain liberty, in exchange for the mutual benefit of living in society, has been severely denigrated by the aberrant Trump administration, the latter, singularly lacking in societal moral compass. Political power, at the expense of moral humanism, has been the Trumpist standard of personal comportment, to the detriment of social conscience and empathy. Such matters, existential to the sustainment of society, are experiential and will necessarily require remedial education.

The most catastrophically harmful impact on the metaphysical existence of human society has been Trump’s egregiously immoral, toxic, anti-social attack upon the fundamental concept of “TRUTH.” The delusionally egocentric Donald J. Trump has threatened the entire “Barrel” of human society, with rank spoilation, by his doctrinal derogation of the existential societal element of “Truth,” and has perversely supported the neurotically dystopic franchise for the convenient assertion of “alternate facts,” and “fake news.”

Without reliance on the North Star expectation of truth, there can exist no meaningful, useful interaction between individual Homo sapiens or the feasible existence of civilized society. The American citizen has recently and painfully learned that the venerated apple barrel of human freedom and democracy is large but alarmingly and regrettably, vulnerable.

As a consequence, the traditional American citizen has stunningly witnessed a full measure of tyrannical rule, including, a Gestapo-like utilization of a Ku Klux Klan-style, masked militia, to arrest, incarcerate, and banish peaceful Hispanic Americans to foreign torture prisons, without due process, and startlingly contrary to established federal law, (“posse comitatus”), the illegal deployment of the military against America’s own sovereign states; allegedly to fight crime, but in perverse cempirical reality, to weild unlimited,. monarchial power. The troubled American citizen has also witnessed Donald Trump’s derogation of educational institutions, the media, and, bizarrely, the metaphysical existence of “truth, itself.

Such a heinous impact is horrifically universal, affecting every aspect of governmental function and of individual life. The present dismal state of the Nation has prompted fear and despair among traditional American citizens. Despite such nightmarish developments, we, in previous writings, have confidently predicted that the freedom-loving American Nation will soon prevail over such fearsome, ubiquitous tyranny.

In the interim, we are factually justified in the conveyance of some cheer to mitigate the contextual conglomerate morass of political misery by happily taking note of a heartening societal development, a “shiny object” of inarguably precious value has been recently uncovered to assuage the dire concern of our multi-troubled fellow citizens, which, indeed, may ultimately be more fundamentally significant than the thematic, temporal political dystopia.

As our regular readers are doubtless aware, we have been severely critical of the unwholesome substitution of natural conversation, viz., person-to-person or telephonic, by the facile, but socially inhibiting interaction of “smartphones.” The impact on the young has been especially negative; viz., the absence of personal, intimate, and identifiable interaction, among its other myriad of detrimental effects, results in a significant developmental handicap to the young by its empirical denial of the salubrious impact of the enlightening nuance of personal response; the latter, existentially necessary in the development of an individual sense of personhood and referable self-image. Studies report a significant increase in anxiety and depression among the younger generation who seem to exclusively communicate by smartphone, thereby stultifying the universally dynamic responsible for the development of personal identity and a referable self-image.

Despite, as recounted above, being troubled by the present political state of affairs of the Nation, we are nevertheless simultaneously heartened by the media-reported advent of the long awaited recognition of the psychological impact of smartphone communication and its consequent, salubrious limitation of their use by the young at school; the same is hoped to portend the advent of the apporopriate full recognition of the etiology of a longstanding societal inter-active impediment.

The vital recognition and media reported initial steps at the amelioration of the deleterious social effect of smartphone interaction, by their recent proscription at schools, albeit contextually unrelated to the presented theme concerning the Nation’s political morass, are nevertheless encouraging and serve an analogical function to the finding of a valuable small shiny object in a pile of offensive rubble. The mainstream American citizen has alarmingly observed, with Donald Trump’s programmic attack on “truth,” on institutions of higher education, on the Nation’s institutional media, its Federal Civil Service, the latter, inclusive of its cestablished, vital health research services, heartlessly eliminated programs of relief (food and medicine) to the needy, domestic and international, arrogated to the federal government women’s right to decide on personal matters of birth and size of family, approved and encouraged book and speech censorship, unconstitutionally utilized his cabinet, most notably, the Office of the U.S, Attorney General, to wreak vengence upon his “political enemies,” befriended and assisted the Nation’s perverse White Christian Militias, irresponsibly removed our Nation from morally responsible and salutary environmental treaties, eliminated regulations protecting citizen health, labor, and safety regulations, inclusive of those relative to food safety, water, purity, medicines, clean air and airplane travel safety.

This accusatory demagogue has, himself, publicly committed voter fraud and incited a violent and bloody insurrection against the Capitol. Trump has befriended the Nation’s sworn enemies and befuddled its historic allies, including NATO, publicly announced his delusional ideation to aggressively acquire Denmark’s sovereign state of Greenland, and our contiguous, friendly neighbor, Canada, he has been adjudged guilty oif 34 felonies and criminally indicted for an additional plethora of other venal criminality, such criminal indictments held in abeyance (only) due to his office, he has been adjudicated a tax fraud and a sexual abuser and, further to his credit, was a longtime. busom buddy of Jeffrey Epstein, the entrepreneur of the celebrated box-store child prostitution enterprise.

Trump’s egregiously un-American activities may best be exemplified, perhaps, somewhat overshadowed, by his heartless inhumane xenophobia. Spearheaded by the arrogantly contemptible Steven Miller, peaceful, productive, and tax-paying Hispanic Americans have been wrongfully manhandled, arrested, incarcerated, and banished to foreign torture prisons, without a modicum of constitutional due process, including heartless family separation, based upon their incriminating tan skin and language. Such, fascist-like war against innocent members of a tactically designated ethnos is empirically redolent of the historic cruelty of Andrew Johnson’s “Indian Replacement Program,” and World War 2 incarceration of Japanese American citizens. The horrific terror of this autocratic and heartless program is dynamically exacerbated by the Administration’s use of a private, Gestapo-like militia (“ICE”) wearing dystopian face masks in the pernicious style of the Ku Klux Klan. This nightmarish, anti-American, Trumpist travesty is beyond reprehensible and antithetically non-American.

It might credibly appear that such extreme, fascistic, and inhumane xenophobic practice might qualify as the zenith of the Trump-MAGA arsenal of un-American travesties; nevertheless, in that toxic milieu, there appears to be no conceivable or ascertainable limit. Despite its rational inconceivability, Donald J. Trump, the (dystopic) President of the United States, has implausibly and delusionally. declared War against the Nation by (illegally) sending American military troops to selected States, to secure peace and safety upon alleged non-existent, propagandistically declared, high levels of crime.

Human history would undoubtedly attest to the exotic singularity of an autocrat or monarch who chose to declare war against their own country; however, this may be the first time the American Nation has experienced the extent of Donald J. Trump’s aberrational persona.

We stated that certain prescribed rituals performed with the evergreen trees, which, unlike other flora, were observed to magically survive the cold winter, faithfully for a few months, restored life to the “Sun God.” concomitant with the revitalized flora and fauna. We were bold enough to opine that early rituals, involving such natural phenomena, were doubtlessly responsible for the advent of religious belief in death and resurrection.

We choose to maintain an analogous dynamic relevant to the present governmental dystopia and its threats to American constitutional democracy. Man’s long enjoyment of the unfettered franchise for personal development and fulfillment is inarguably “Evergreen,” i.e., never withered or wilted. The existential desire for freedom of expression and action, once experienced, is systemic and everlasting.

The cold and forbidding ambiance of neo-authoritarianism of the present Trump-MAGA administration, analogous to the temporally forbidding cold of the Winter Season, will, in due course, be fully resurrected to the traditional American freedom and way of life, with the analogous certainty to Man’s expectation of the natural changes brought about by the fixed orbit of our Planet around the Sun.

Having historically tasted its empirically sweet and emancipating joy, we are supremely confident that the entire Nation will, in short order, adamantly express its preference for the assured liberty implicit in the American Constitutional way of life. The American citizens’ desire for freedom is experiential, perennial, and eternally “Evergreen.”

Of the veritable legion of odiferous dumpster-fulls of Donald Trump’s obscene anti-American acts, the “tan holocaust,” i.e., the Hitler-like program of victimization and abuse of peaceful, productive, and law-abiding Hispanic Americans, may rank among the most foetid.

The present government, under its current, perverse and dystopic leadership, in its desire for the acquisition of supreme autocratic power, has echoed the fascistic playbook of Adolf Hitler, history’s most notorious tyrant. Strategically singling out a designated category of the American population, as Hitler did with respect to the Jews, the would-be autocrat, Donald J. Trump, has tactically selected our Hispanic American neighbors for victimization.

Our Nation’s despotic, power-hungry style of Chief Executive, in orthodox observance of modern history’s foul and detested Holocaust Field Guide, has tactically chosen the empirically identifiable, viz., tan-skinned and Spanish-language-speaking individuals, as the scapegoat du jour.

Despite official statistics generally attesting, to their productive, tax-paying, and patriotic military service, our dystopic President, albeit (himself, adjudged guilty of no less than 34 felonies with an additional score of federal criminal indictments, held in abeyance, merely due to his Office, with personal adjudications of rape and sexual abuse, tax fraud, bribery in exchange for non-disclosure of his brisk commerce with prostitutes, demonstrated long term bosom buddy relationship with the child sexual abuse magnate, Jeffry Epstein, and overt despiser of the Nation’s Constitution and established Rule of Law, abuser of the societal moral compass, has publicly rationalized the thematic and contemptible policy as “ridding the Nation of criminals.” Such carnival mirror distortion, unfortunately, has been blindly and cultishly accepted by his cultish lemmings, d/b/a, “MAGA.”

The horrific optics are inclusive of the Presidential, nightmarish authorization of a masked Gestapo-style private army, to wreak traditional Ku Klux Klan styled misery on the contextually scapegoated population, including physical abuse, unlawful arrest, incarceration, banishment to foreign torture prisons, and separation of families; all without a scintilla of validity or mandated constitutional due process.

It is our presumption that, in light of the evident popularity of the American Civil Rights movement, relevant to the goal of equal rights for black American citizens and the relatively recent history of the European Holocaust against the Jewish people, the Nation’s population of the Hispanic ethnicity was the pragmatic, reprehensible, and evilly-inspired choice.

All Americans of goodwill, Latino and otherwise, as American citizens, are morally and principally obliged join in a concerted effort to oppose Donald Trump and his MAGA supporters in their malign efforts to undermine our democracy, inclusive of the present contextual, Kristallnacht-like effort to prosecute fellow Hispanic-American neighbors, as well as Donald Trump’s detestable plethora of un-American travesties, including autocratic violation of posse comitatus, Nazi-style retribution against political rivals, denigration of the media and of higher education, and autocratic despoilation of the fundamental tenets of the American Constitution.

[Historical Provenance]: It was the universally celebrated virtuoso of the originally three-hole noiseflute, Maestro Ignatz Volvarian (1919-1979). The Maestro garnered world acclaim by his superlative, heart-stopping performance of the “Bohemian Rhapsody, on his venerable three-hole noseflute before the assembled German and Russian delegates at the signing of the Treaty of Brest-Litovsk. Since that time, descendants of the musical genius have perpetuated the aesthetic fame of the contextual musical instrument, recently and metaflusively enhanced by the addition of an impactful fourth hole.

The contemporary beneficiary of the contextual musical skill is the grandson of Ignatz Volverian, Igor Ramos Volvarian, whose performances before the myriad of nose flute aficionados, reportedly, have earned him international accolades. It had long been discovered that the contextual nose flute produces tones that are not entirely suitable for recording, despite the progressive and impactful addition of a fourth hole, so that musical aficionados of the instrument found that personal attendance at participating music venues, such as the Met and Carnegie Hall, aesthetically permitted the true potential for the exploitation of the instrument’s potentially profound depth of exhalatory emotional expression.

As an indirect, yet exceedingly profitable consequence of the growing taste for such esoteric music, television sales of specific pharmaceuticals claiming relief from nasal congestion have skyrocketed, and young Igor Ramos Volvarian benefited financially from such grateful and generous companies. With monies earned from his musical performances, and the addition of such gratuities, the young nose-flute empressario, factually assured of financial stability, married the daughter of a prominent couscous manufacturer, and soon after having two children by his bride, Brunhilda, viz., a son. Ignatz, Jr, and a daughter, Ramona-Immaculata, purchased a suburban home in Great Neck, Harbor, New York.

As luck would have it, a post-graduate student at Stony Brook University, engaged in field study on the Long Island Pine Barrens, discovered that her recorded nose-flute music, played during her rest breaks, consistently attracted Hummingbees and huge clouds of Monarch Butterflies. She excitedly photographed the beautiful flying creatures and subsequently included them in a published book, the latter, founded upon her thematically altered doctoral thesis, quickly became a best-seller, based on the exemplary kudos published in Sierra Magazine. Sales of the book, as well as newly engineered and acoustically improved recordings of Igor Ramos’s nose flute offerings, now hit their zenith; the young Valvarian family had suddenly and fortuitously become rich and famous.

We are led to empirically conclude that in our free and enterprising Democratic Republic, the attainment of great financial success is eternally possible and, inarguably, nothing to sneeze at.

Cooling balm to sunbaked foliage.
Trees, now attired in military raiment,
In styles bespeaking revolutionary riot,
Proclaiming in an eye-sparkling manifesto,
The swift advent of seasonal overthrow.

Boughs strain heavy with seasonal fruitage.
The bounty, tho’, forsaken by large mammals,
In search of safer havens
Alas, no time for juicy gorging,
Time’s to be spent for seasonal survival.
Smaller ones, storing food, burrowing deep.
Instinct warns, dalliance spells disaster!

Winged creatures depart aloft
Huge flocks with little hesitation,
Escaping to safer geography.
Could one but hear beneath the forest floor,
The excited chatter of woodland critters,
Anxiously nose-wrinkling rodent reconnaissance
-Is there yet time?

Darkening clouds bespeak woodland calamity
Soon, winter gales, storms, sheets of ice,
Snow, that covers safe niches and hide-outs,
Cold that delights in shivering death.
All must forsake the Fall magic.
